With Election Day fast approaching, California voters will decide on Proposition 45, which would create a new California Environmental Quality Act (CEQA) track for eight categories of “essential projects”: housing, clean energy, water, public health, public safety, broadband, education, and transportation. If approved, it would take effect as soon as the election is certified, bringing strict deadlines for completing CEQA documents, an optional new scoping process, limits on alternatives analysis, a tribal consultation process open only to federally recognized tribes, and significance determinations and legal challenges based only on compliance with objective existing laws. Building on our earlier summary, this AscentShare looks at how these changes might work in practice. Drawing on their daily work implementing CEQA for public agencies and private applicants, leaders in our environmental practice walk through some of the potential benefits, challenges, and open questions, along with first practice steps lead agencies may need to take if Prop. 45 passes. The article is neither an endorsement nor an argument against the measure. It is intended to help agencies and project teams understand the changes and how to prepare for them.
