As another step in implementing the President’s environmental policy framework, including Executive Order (EO) 13807, on June 20, 2018 CEQ posted Advance Notice of proposed rulemaking to update National Environmental Policy Act (NEPA) regulations, 40 Code of Federal Regulations 1500-1508. Requirements for streamlining NEPA consistent with the EO currently include process time limits (1 year for the Department of Interior) and Environmental Impact Statement page limits (150 pages, or 300 pages for unusually complex projects). The Advance Notice requests public input on 20 specific questions, three related to NEPA process and 17 related to the scope of NEPA review.
Practical approaches for streamlining NEPA are described in the AscentShare paper, Practice Implications of Recent Federal Directive to Streamline NEPA. The paper contains hyperlinks to all the relevant orders and guidance documents you need to develop your approaches.
The comment period for public input in response to the Advance Notice ends July 20, 2018. Please watch for updates on the rulemaking process after that date.
We would love to hear your thoughts on this developing issue and any challenges you have experienced.
